Memorandum To: Project File, Mayor, Bidders, WSDOT Local Programs From: Ingrid Gaub, Public Works Director ______________ Signed 10/08/2026 _________ Date CC: Jeffrey Bender, Senior Project Engineer Jacob Sweeting, City Engineer/Assistant Director Engineering Services Re: Reject All Bids for Public Works Contract 26-16, CP2505 – Lake Tapps Street Lighting (Sumner Tapps Hwy E to 182nd Ave E) Project In accordance with Section 1-03 (Award and Execution of Contract) of the Contract Provisions and as allowed by Auburn City Code 3.12.040, all submitted bids associated with Project No. CP2505 – Lake Tapps Street Lighting (Sumner Tapps Hwy E to 182nd Ave E) Project are hereby rejected. On October 1, 2026, bids were opened for this project and the City received ten total bids. Section 1-02.6 (Preparation of Proposal) of the Contract Provisions included a requirement that bidders submit a completed Subcontractor List with their bid. Per the provisions, the list must identify subcontractors performing HVAC, plumbing, electrical, structural steel installation and rebar work. Per this section bidders were required to use DOT Form 271-015LP if a form was not provided in the Bid Proposal Package. Per RCW 39.30.060 (Bids on public works—Identification, substitution of licensed subcontractors) a Subcontractor List is only required on projects expected to cost $1,000,000 or more. Per ACC 3.12.020(D), for the purposes of determining whether or not bidding contractors must declare the names of subcontractors for certain work based on the amount of the contractor’s expected costs per RCW 39.30.060, the expected costs of the contract shall be the engineer’s estimate of the contract work. Since the Engineer’s Estimate for this project was $858,070.00 the City did not intend to have bidders submit a Subcontractor List with their bids. Therefore the City did not include a Subcontractor List form or instructions to use this form in the Bid Proposal Package as would typically be done when a Subcontractor List is required. Of the ten bids received only one included DOT Form 271-015LP as required by Section 1-02.6. Two bids included a Subcontractor List but not on the exact form specified, and seven (including the apparent low bidder) did not include a Subcontractor List at all.
