STATEMENT OF RESPONSIBILITY Austin Small and Minority Business Resources STATEMENT OF RESPONSIBILITY Minority-owned Business Enterprise and Women-owned Business Enterprise Procurement Program City Code Chapters 2-9A and 2-9B, as amended, establish a Minority-owned Business Enterprise and Women-owned Business Enterprise (MBE/WBE) Procurement Program in Construction and Professional Services. The aim of this program is to promote MBE and WBE participation in City procurement, through its prime contract awards and subcontracts, and to afford MBEs and WBEs an opportunity to compete for City contracts. In particular, this program encourages contractors to provide opportunities to certified MBEs and WBEs for subcontracts or related contracts. A “Subcontractor” is defined by the Ordinance and for the purposes of this form as any person or Business Enterprise providing goods, labor, or services to a contractor if such goods, labor, or services are procured or used in fulfillment of the contractor’s obligations arising from a contract with the City. In accordance with City Code Chapter 2-9A, as amended, goals for MBE and WBE participation differ from contract to contract, based on the type of contract, the availability of MBEs and WBEs to perform the functions of the contract, and other factors. This Statement of Responsibility is related to the Request for Proposal for FM 812 Landfill Solar project to solicit to potential Proposers for the development, engineering, procurement, construction, commissioning, maintenance, and warranty of a utility-scale solar photovoltaic system. SMBR has determined no MBE/WBE goals will be applied to the Power Purchase Agreement between Austin Energy and the Awardee (Developer) for the Purchase of Renewable Energy. The selected Developer will build, own, and operate the system. Therefore, SMBR has determined that potential subcontracting opportunities will arise during the Construction Phase of this project. Although specific scopes of work and the magnitude of the scopes of work for the Construction Phase cannot be determined at this time, the Developer is required to contact SMBR to determine the appropriate MBE/WBE goals prior to the awarding contracts for the construction phase. Should goals be established, the Developer shall submit a MBE/WBE Compliance Plan meeting the goals or documentation detailing their Good Faith Efforts. I understand that I am responding to an Austin Energy Request for Proposal (RFP) Solicitation.
