The RFQ requires nonresident contractors to submit a copy of their state's current preference law, if any, pursuant to Miss. Code Ann. §31-3-21(3). Because Texas does not have a resident contractor preference statute applicable to public construction contracting, would MDA confirm that a statement indicating Texas has no applicable preference law will satisfy this requirement? Additionally, please confirm whether Mississippi's resident preference provisions will be applied in the evaluation or award of this federally funded CDBG-DR procurement, or whether the procurement will be conducted in accordance with the federal procurement requirements under 2 CFR Part 200. Yes, a statement indicating Texas has no applicable law will be sufficient. Miss. Code Ann. § 31-3-21(3) enforces reciprocal resident contractor preferences in public contracts. It requires that an out-of-state bidder's home-state preference laws be applied against them, meaning a nonresident contractor is only awarded a Mississippi public project on the exact same basis that their home state treats Mississippi bidders. The procurement will be conducted in accordance with the federal procurement requirements under 2 CFR Part 200. 2. The RFQ requires the Respondent's COR Number to appear on the outside of the response package and identifies the Certificate of Responsibility as supporting documentation. Please confirm whether a copy of the current Certificate of Responsibility should be included immediately following the cover letter (or cover page), or whether MDA prefers it in another location within the proposal package. There is not a specific location for the Certificate of Responsibility to be submitted, as long as it is included in the submission and it is clearly identifiable. 3. Will MDA evaluate and award contracts on a regional basis (North, Central, South), or will respondents be evaluated statewide with MDA assigning work regions after award? May a single contractor receive assignments in multiple regions? MDA will make this determination based upon the need of the program at the time. 4.
