SECTION 00 XX XXXX CITY OF ROCHESTER PROFESSIONAL SERVICES COMPLIANCE REQUIREMENTS 1. PROFESSIONAL SERVICES COMPLIANCE REQUIREMENTS 1.1 Definitions For purposes of these compliance requirements, the following definitions apply: Proposer: A firm or entity submitting a proposal in response to the solicitation. Upon contract award, the selected Proposer becomes the Prime Consultant. Prime Consultant: The firm or entity contracting directly with the City of Rochester to provide professional services under the agreement. Subconsultant: Any consultant, professional service provider, or other firm retained by the Prime Consultant to perform a portion of the professional services required under the contract. Targeted Business (TB): A business certified as a Disadvantaged or Targeted Business Enterprise through one of the following programs: • • • Minnesota Unified Certification Program (MnUCP) Minnesota Department of Administration Targeted Group/Economically Disadvantaged (TG/ED) Program, or The City of Saint Paul Central Certification (CERT) Program Relative Availability: The methodology used by the City to establish a Targeted Business participation goal by comparing the number of certified Targeted Businesses available to perform the anticipated professional services with the total number of businesses capable of performing those services within the applicable geographic market. Workforce Participation: The representation of women and people of color within the workforce performing professional services under the contract, where Workforce Participation requirements have been established. 1.2 Applicability These requirements apply only where one or more compliance requirements have been established in the solicitation or contract documents. Applicability is determined based on the funding source, project type, and specific contract provisions. Where a compliance requirement is not included in the contract, that requirement shall not apply. The City of Rochester Compliance Team, in coordination with the Project Manager, will monitor compliance with applicable professional services compliance requirements for the contract. 1.3 Compliance System Onboarding Requirement Prior to the commencement of professional services, the Prime Consultant shall ensure that the project and all applicable subconsultants are registered and active in the City's designated compliance reporting system.
