The Contractor must include flood insurance either by endorsement or by separate policy. DIVISION IV – GENERAL PROVISIONS 40-09 First paragraph should read…. The Contractor shall take out and maintain during the life of the Contract Builder’s Risk insurance or Installation Floater, written on an “All Risk” basis, insuring the work included in the Contract against all physical loss. The amount of insurance shall at all times be at least equal to the amount of the Contract. The Contract must include flood insurance either by endorsement or by separate policy. Flood insurance must be issued by either the National Flood Insurance Program (NFIP) or a private insurer meeting statutory requirements of the Biggert-Waters Act. Flood insurance policies not issued by NFIP must provide coverage at least as broad as NFIP coverage. The policy shall be in the names of the Owner, Engineer, Contractor and “all Subcontractors,” as their interests appear. Policy shall be provided to the Owner prior to commencement of work. Stan Gottlieb, APTIM Port Services, then gave an overview of the project.
