REQUEST FOR QUALIFICATIONS (RFQ) BEAD Challenge Adjudication Services RFx# 314003911 Amendment # 1 Questions and Answers Question Section # Page # Question DFA Response 1. 2.5 and 2.8 (16) 12 of 38 13 of 38 Section 2.5 and 2.8 appear to be in conflict. Can the State please confirm that vendors who include exceptions to terms and conditions, to be negotiated prior to award, within the provided form will not be deemed unresponsive? DFA reserves the right to reject any terms and conditions that do not conform to the terms and conditions specified within the RFQ. DFA will accept exception requests submitted in accordance with Section 9, Compliance and Contract Exceptions (p. 30 of 38). Offerors may only request exceptions to the contract terms that are not required clauses. See Section 1.11 Compliance Requirement and Contract Exceptions (p. 8 of 38). If DFA and the selected offeror cannot reach agreement regarding any contract modifications requested by Offeror, DFA reserves the right to reject the qualifications as nonresponsive and move to the next vendor for contract negotiations, cancel the solicitation, or take any other action afforded to DFA in accordance with the RFQ, OPSCR Rules and Regulations, and/or Mississippi law. 2. 3.2 18 of 38 States, "Offerors must certify that it is financially solvent..." Please confirm if a statement attesting to financial stability is sufficient to meet this requirement. Offeror meets the certification requirement by signing and submitting Appendix E-Offeror Certification of Minimum Qualifications.
