NEW JERSEY ECONOMIC DEVELOPMENT AUTHORITY REQUEST FOR PROPOSALS FOR Aspire Program Application Support (Reference RFP #2026-RFP-276) ADDENDUM #1 Date: July 14th, 2026 The following constitutes an Addendum, which can be a Clarification and/or Modification to the abovereferenced solicitation. This Addendum is divided as follows: • • Part 1: Answers to Questions Submitted Part 2: Additions, Deletions, Clarifications and Modifications to the RFP Part 1: Answers to Questions Submitted No. Question Answer 1. Why has NJEDA released this RFP when the scope of services (as detailed on pages 17-18) is already included in NJEDA’s # 2024-RERFQ-221, which has been contracted? 2. Pg. 6, Section 1.3.1.1: Regarding the Authority’s Contract for Professional Services, we would require the following edits to proceed. These exactly match language previously approved for past contracts with NJEDA. NJEDA has determined that the Aspire Program's specialized requirements, anticipated workload, and ongoing operational needs warrant a dedicated contract vehicle. Accordingly, this RFP is being issued to procure services specifically tailored to support the Aspire Program and its application review process. A. Respectfully, the Authority will not make the proposed revision. a. Add language in Sec 6, Indemnification: The Vendor shall be liable to the Authority for any reasonable costs incurred by the Authority to correct, modify, or redesign any technical information, reports, findings, analyses, surveys or drawings generated or produced by Vendor or any Work performed by the Vendor or its subcontractor(s) that is found to be materially defective or not in accordance with the provisions of the Contract as a result of any grossly negligent act, error, or omission on the part of the Vendor, its officers, agents, servants, employees and subcontractors. The Vendor shall be given a reasonable opportunity to correct any deficiency. b. Strike Sec 10, Time for Completion and Damages, in its entirety REV. 05/19/2021 B. Respectfully, the Authority will not make the proposed revision. 3. Pg. 17, Section 3.2: The scope of work includes “Complet[ing] market and feasibility analyses of commercial and residential projects,” and “provid[ing] reporting support as needed.” Elsewhere, the SOW is described as “review[ing] and validat[ing] market studies” (or reports) submitted by an applicant.
